District Court in Bearden was held on July 20, at City Council chambers at city hall, Judge Dan Ives presiding. Judge Ives quashed the case of Kenny Rogers of Bearden. Court records indicate that Rogers is incarcerated at the Ouachita County Detention Center on circuit court charges. As of court date, Rogers owed the city $1,500.00 for failure to appear fines. Judge Ives noted that Rogers has until August 17, the date of the next district court session in Bearden to pay $500.00 and his fines will be settled with the city. Angel Ankeny, whose address was not available, did not appear in court on a theft of property charge. Judge Ives set her bond at $500 dollars. Cole Cain of Bearden, charged with possession of drug paraphernalia was ordered to pay $200.00 in full within 60 days. 44 year old Amy Caldwell of Bearden had her court date reset for next month, August 17. She has charges of possession of a controlled substance, driving on a suspended license, two counts of failure to appear, theft of services, three counts of possession of drug paraphernalia, carrying a prohibited weapon and failure to pay fines against her. Amanda Foust of Camden had $100.00 of her fine for theft of property suspended and was banned from Dollar General for one year by the city and seven years by Dollar General. John McClain of Bearden did not appear in court on 2nd offense of driving on a suspended license. Judge Ives set his bond at $500.00. Darryl Patton of Norphlet plead not guilty on a speeding violation and no proof of insurance. His case was reset for August 17. James Peters of Bearden, charged with speeding 90 in a 65 speed zone, careless driving, fleeing on foot and possession of drug paraphernalia had his case reset for August 17. Jacob Warnack of Bearden failed to appear in court. He was charged with driving on a suspended license, no proof of insurance, possession of drug paraphernalia and displaying fictitious tags on his vehicle. Bond was set at $1.000.00 on the suspended license charge and $1,000.00 on failure to have liability insurance and $500.00 bond on the fictitious tags charge. Donald Lawson of Bearden, charged with drinking in public was ordered to pay $100.00 by next court date or the fine will be increased to $265.00. Homer Jones III of Bearden was told by Judge Ives that if Jones pays $1,500.00 as payment in full, all fines and costs against him will be deemed void. Court records indicated that as of January 1, Jones owed the city over $4,200.00. The 239th traffic fatality of the year was recorded in Sebastian County on U.S Highway 71 at Brooken Hill Drive in Ft. Smith. According to a preliminary state police report..63 year old Janet Kessler died of injuries suffered in a crash involving three vehicles. Kessler's 2014 Chevrolet Cruze..eastbound on Brooken Hill Drive was hit broadside by a southbound 2006 Toyta Tacoma..the light changed and the driver of the Tacoma attempted to stop..but not in time and struck Kessler's vechile on the drivers side..Kessler's car then spun into a light pole and then collided with a a north bound 2015 Hyundai Sonota..who was stopped in the northbound turning lane of U.S. 71. The drivers of the other vehicles not available in the report. The injured were taken to a Ft. Smith hospital..where Kessler died of her injuries. Weather conditions were clear..the roadway dry at the time of the crash at 11:14 Thursday morning. Ft. Smith PD investigated. |
